Terms and Conditions

Welcome to FuelRadar Australia. These Terms and Conditions ("Terms") govern your access to and use of the fuelradar.com.au website and associated mobile applications (collectively, the "Platform"), operated by WebDigital (ABN: 17 453 778 242) ("we", "us", or "our").

1. Agreement to Terms

By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree to all the terms and conditions, you must not use our services. These Terms apply to all visitors, users, and others who access or use the Platform.

2. Eligibility

To use FuelRadar Australia, you must be at least 18 years of age. If you are between 15 and 18 years old, you may only use the Platform under the supervision of a parent or legal guardian who agrees to be bound by these Terms. By using the Platform, you represent and warrant that you meet these eligibility requirements.

3. Account Registration

Account Creation: You may need to create an account to access certain features, such as reporting petrol prices or saving your favourite servos. You must provide accurate and complete information.
Account Security: You are responsible for safeguarding your login credentials and for all activities that occur under your account. Notify us immediately of any unauthorised use.

4. Permitted and Prohibited Use

You may use the Platform to compare real-time petrol prices, find the nearest servo, and navigate to them. You agree NOT to:

Submit false or misleading petrol prices (prices must be accurately reported in c/L).
Use automated systems (e.g., bots, scrapers) to extract data from our Platform.
Interfere with or disrupt the integrity or performance of the Platform.
Use the Platform while operating a vehicle in a manner that violates Australian road safety laws. Always park your car or ute safely before using your mobile device.

5. Petrol Price Data Accuracy Disclaimer

We strive to provide accurate, real-time petrol prices from over 8680+ servos across all Australian states and territories. However, because prices are dynamic and often rely on user submissions and third-party data:

We do not guarantee the accuracy, completeness, or timeliness of any petrol prices displayed (quoted in c/L).
Prices at the servo pump always supersede the prices displayed on the Platform.
We accept no liability for discrepancies between the Platform's data and the actual price charged at the servo.

6. Intellectual Property

All content, features, and functionality on the Platform, including text, graphics, logos, and software, are the exclusive property of WebDigital (ABN: 17 453 778 242) or its licensors. You may not reproduce, distribute, or create derivative works without our express written permission.

7. Premium Services & Payments

FuelRadar Australia operates on a free model supported by advertisements, with an optional premium one-time purchase available via in-app purchase to remove ads and unlock advanced features.

Pricing: All prices are in Australian Dollars (AUD).
Payment Processing: Transactions are processed securely through Apple App Store or Google Play Store, managed via RevenueCat. We do not store your payment card details.
Refunds: Subject to your rights under the Australian Consumer Law, all one-time premium purchases are final and non-refundable unless the digital product is faulty.

8. Privacy

Your privacy is important to us. Our data collection and use practices are described in our Privacy Policy. By using the Platform, you consent to the processing of your information as set out in that policy.

9. Disclaimers & Limitation of Liability

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy implied or imposed by the Competition and Consumer Act 2010 (Cth) or the Australian Consumer Law (ACL) which cannot lawfully be excluded, restricted, or modified. To the maximum extent permitted by law:

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis.
We disclaim all warranties, whether express or implied, regarding the Platform's reliability or availability.
WebDigital will not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Platform.

10. Third-Party Services

Our Platform utilises third-party services to enhance functionality, deliver advertisements, and analyse user behaviour. These include, but are not limited to:

Google Analytics & Google Firebase: For performance monitoring, crash reporting, and usage analytics.
Google AdMob: For delivering relevant advertisements.
AppsFlyer: For mobile attribution and marketing analytics.
RevenueCat: For managing in-app purchases.

Your interaction with these third-party services is governed by their respective terms and privacy policies.

11. Indemnification

You agree to defend, indemnify, and hold harmless WebDigital (ABN: 17 453 778 242), its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Platform or your violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your account and access to the Platform immediately, without prior notice or liability, for any reason whatsoever, including but not limited to a breach of these Terms (e.g., repeatedly submitting fake petrol prices).

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of Australia, without regard to its conflict of law provisions. You submit to the exclusive jurisdiction of the courts located in Australia for the resolution of any disputes.

14. General Provisions

Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
Entire Agreement: These Terms constitute the entire agreement between us regarding our Platform and supersede any prior agreements.

15. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Platform after those revisions become effective, you agree to be bound by the revised terms.
